Commission to Walter Moyle, knight, John Clerk, Humphrey Sterky, John Rowe and John .Cobbe to enquire into the complaint of George Darell, knight, Richard Darell, knight, Constantine Darell, Alexander Darell and Thomas Darell, sons and heirs according to the custom of gavelkind of William Darell, that whereas Robert Sherewynde, citizen and mercer of London, was seised of the manor of Capell, co. Kent, in his demesne as of fee and enfeoffed the said William Darell and Thomas Elys, Thomas Wotton and William Ledys of it to hold to themseives and the heirs and assigns of the said William Darell, by virtue of which feoffment they were seised of it in time of peace in time of Henry iV. and received the esplees thereof and continued their possession until by virtue of an inquisition taken on Wednesday after St. Leonard, 2 Henry V. at Eltham, co. Kent, before Thomas Lygon and William Lee, commissioners of the king, by virtue of letters patent directed to them and one William Tykhill, it was found by verdict of twelve men that Thomas Shelley, knight, who made forfeiture to Henry LV. was seised of the said manor at the time of his forfeiture in his demesne as of fee, viz. on Wednesday after the . Parr III. 71 Henry IV. the manor was taken into the hands of Henry V. the said William, Thomas, Thomas and William were expelled from and afterwards the said Thomas, Thomas and William died and the said Darell survived and after his death the right of the manor to the complainants as his sons and heirs according to the of gavelkind, but that the said Thomas Shelley was not seised of manor or any parcel of it, and afterwards the king by letters patent 7 April, 4 Edward IV. granted the manor to one William Darell the county of Kent, who entered into it and is still seised of it in demesne as of fee, wherefore they pray that justice may be done.
