Lincoln, after the death of Alice, late the wife of the said William, who held the same in dower, the said Ralph had been long in full and peaceful seisin thereof, certain persons suggested to the king that the said lands were held long since of Henry de Longo Campo, lately deceased, who held of the king in chief, the inli ritance of whom by reason of the minority of his heir is in the king's custody, and have procured the seizing of the said lands into the king's hands. Commission to Walter de Helyun to hear, examine, and correct, if necessary, the record and process of an assise of novel disseisin arramed by Robert de Clopton in the hustings of London against Henry de Sob' touching a tenement in London. Commission of oyer and terminer to Roger Loveday aud John de Metingham touching an appeal which Clarice, late the wife of Gilbert Capun, brings in the county of Norfolk against John de Methelwold for the death of her husband. Commission to Geoffrey Leukenore and Geoffrey Russel to deliver the gaol of Aylesbury of John son of Thomas le Chapman, taken and imprisoned for the death of William le Sumenur. Commission of oyer and terminer to Geoffrey de Leukenore and Geoffrey de Picheford touching the following matters : (1) Whereas an inheritance in Hinton by Byfeld fell to Agnes de Hynton and Margery her sister, whom Hugh de Tywe married, and a partition thereof was made between the sisters, and Agnes enfeoffed John de Bray of a virgate of her purparty, John son of the said Agnes asserting that he was enfeoffed of the said land and had obtained good seisin thereof, arramed an assize of novel disseisin against his mother and John de Bray, and recovered seisin thereof; but the said John was not convicted because of the entry which he had therein by feoffment of the said Agnes. And whereas afterwards the said Hugh and Margery his wife, and likewise the said John, caused a shot (cultura) of land in that town, wherein an acre of the above virgate recovered by John son of Agnes lay, to be sown and put in defence wthout the assent of the free tenants of the town, which according to ancient custom is necessary ; the free tenants, whereof John de Bray is one, and Agnes, co-parcener of Margery, claiming common of pasture in the said shot, entered it with their beasts and depastured it, whereupon Margery arramed an assize of novel disseisin against them all, and by judgment of the court recovered her seisin. But at this assize it was objected on the part of Agnes that she had made no disseisin because she was co-parcener with Margery in that shot, so that judgment is still pending against her. 7 EDWAED I. 341 Also John de Bray, asserting that the jury of that assize had made a false oath, arramed an attaint against the said Hugh and Margery, and being beyond seas, appointed Henry son of Roger Bockoynt his attorney, and the taking of that attaint is still pending. The said John son of Agnes, finding that Hugh and Margery had recovered their seisin, obtained a writ of re-disseisin against Agnes and John de Bray, by reason of that acre of land, which he has within the said shot, previously recovered by him ; but he caused to be inserted in his writ of redisseisin Hugh le Despenser, William le Mey and Roger Bockoynte, which were not contained in the writ of novel disseisin, and caused them by sinister procurement to be convicted upon that re-disseisin by men suspected by them, and to be taken, and they are still detained in prison on that account. And by pretext of this contention, the above-mentioned Henry, attorney of John de Bray and hayward (tnessor) of him and the said free tenants, was killed by Richard de Keynes and Roger de Tywe, household servants (manupastos) of the said Hugh and Margery by command of the said Margery, Hugh her son, John son of Agnes and John de Preuis, and secretly buried in the twilight in the fields of Faluesle and was afterwards disinterred by some persons. And Roger his father and other relatives, hearing of his death, sought everywhere, and his brother happened to find him, and on finding him raised the hue and cry ; and when this came to the knowledge of the coroner of those parts he went thither, as belonged to his office, and having summoned the township in the usual way, caused inquisition to be made of the death, and it was found that he was killed by reason of the said contention. But on a second and third inquisition by the said coroner and the sheriff of the county it was found by his ill-wishers and by persons from the remote parts of the hundred, that he was disinterred by Roger his father, William le Mey, Hugh de Faluesle and Arnold le Wodeward and carried thence to the spot where he was found, and these persons are on this account detained in prison. Emma, sister of the deceased, has brought an appeal against Richard de Keynes and Reginald de Tywe of the fact and against Margery, Hugh her son, John de Hinton and John de Preuis of commanding his death, but sued the former only in the county of Northampton. The commissioners are to examine the record and process of the above inquisition of re-disseisin, to enquire touching the death of the said Henry, to receive the ransoms due to the king for the said re-disseisin, and to determine the premises. Whereas by divers encroachments (occupaciones) upon the king and others, both rich and poor as vy ell in demesnes, fees, feodalities and liberties, as in divers other things, both the king and others have sustained losses, and in order that the king and others may knovsr what is and ought to be his and theirs, the commissioners are to view all cities, boroughs and market towns in the counties of Warwick and Leicester, as well within liberties as without, of all persons whatsoever, rich or poor, and to enquire as well of the king's demesnes, fees, feodalities, escheats, liberties, and all things touching the fee and tenement, as of those of other persons, and who holds them, to wit, whether in demesne, villeins, services, cotters ; and afterwards in free tenants, woods, parks, chaces, wai-rens, waters, rivers, liberties, fairs, markets, and other tenures whatsoever ; in what manner and of whom, whether of mesne [lords] or of others, and from what fees or other tenures scutage used or ought to be given, and how much from the fees of all honors, and who hold such feodalities, and in what manner. So that all towns, hamlets, and other tenures shall be written in books, to be delivered to the king by the commissioners, in such a way that no one is spared, and everything relating to the premises is made fully clear to the king and others. The commissioners are therefore to go personally to all and singular places of the said counties, and by juries of knights and others thereof, as also by faithful examination of all persons concerning their tenure and fees, to execute the premises in the said form ; and to do it in such a manner that their circumspection may be perpetually commended, and so that they may not be confuted by a fresh inquisition or attaint for negligence or insufficiency. Northampton, and took away a great part of the said bishop's hay to King's Sutton, and wasted and consumed the remainder of the said hay and a large quantity of beasts, burned the granges and other houses, grain, and other goods of the said laishop at the said manor, ill-treated his men fishing in his free fishery of the water of Charewell, and took away their nets and the fish they had caught to King's Sutton. Commission of oyer and terminer to Guncelin de Batelesmere, justice of Chester, and William Bagot, touching the persons who as.saulted Henry de Wyrkesworth in the fields of Mokeleston, co. Stafford, and maimed him, and robbed him of his goods. The like to Stephen de Penecestre touching the persons who carried away certain wreck, to wit, timber, iron, cloth, and other goods, seized by the bailiffs and officers of the prior of Christchurch, Canterbury, in the demesne land of the said prior of Lyde ; the said prior claiming wreck in all his demesne lands by charters of former kings of England. The like to the same, on complaint by the said prior that Richard de Pevenese, the bailiff of Eleanor, the king's mother, of Rye, John de Pettested, Alexander de Keggemere and John Scot, who together with others of the said town and with the assent of the whole commonalty thereof, took and imprisoned the men of the prior of Christchurch, Canterbury, of Apeldre, crossing by sea towards Winchelese on the business of the said prior for certain undue customs which the said men refused to pay, and detained them until a heavy ransom had been extorted from them ; the said prior claiming that by charters of former kings of England he and his men are quit of all customs throughout the realm as well by sea as by land.
