Writ to [Robert Fulk] to enquire whether Robert son of Richard de Wlturton killed Michael de Wlturton by mischance or of malice aforethought. The sheriff of Norfolk has been ordered to find a jury. Westminster. 15 October 54 Henry III. [1270.] Inquisition : Before Robert Fulcon . Norwich. The morrow of Ash Wednesday 55 Henry III. A dispute arose between the said Robert son of Richard and Michael as to the purchase of certain lands. They met on the said land, and the said Michael assaulted the said Robert, striking him on the arm with an iron fork (furca ferrea). The said Robert made shift to get away, but the said Michael followed him meaning to strike him with his fork again on the head; and the said Robert considering this, lifted up a fork he had in his hand to strike the said Michael's fork which was lifted up against him, lest the said Michael should strike him again; and by mischance he struck the said Michael a side-blow (ex transverso) on the head causing a very small wound, whereof however the said Michael died three days after; but the said Robert had no intent to kill him, but only to prevent him from striking him a second time.
