He has paid 20s. of the rent to John in name of seisin. Dated at London, 10 October, Edward III. Witnesses: Henry Pycard, Simon Dolsely, Henry John de Rothynge, John Chaucer, citizens of London, Sir William William de Darsham, John de Berland, Adam de Eredale, John Bergholte of Essex. Memorandwn that Edmund came into chancery at London on 22 October acknowledged the preceding deed. Enrolment of indenture testifying that whereas Edmund de Sutton son Hamo de Sutton, co. Suffolk, is bound to John de Stodeye, citizen and of London, in 400/. for merchandise bought from him, as appears a statute merchant acknowledged before Andrew Aubrey, then mayor of and Thomas de Colleye, then clerk appointed to receive the of debts in that city, which acknowledgement is dated at on 19 April in the 26th year of the reign, to be paid to John or to attorney on the quinzaine of Easter next; and whereas Edmund to John a yearly rent of 10/. of his lands in Hokkele, co. Essex, appears by the preceding deed; and further whereas Edmund has now John of all his lands in the city of London in the parishes of St. Martin in Vintry and St. James Garlekheth by his charter, which lands lately recovered against Walter Turk by the king's writ of novel the date of the charter and seisin being 12 April in the 26th year the reign, John grants that if he holds the said lands in the said parishes hindrance of Edmund or of any other by reason of any recognizance contract made by Edmund, except alms, chantries and quit rents due to houses and services due to the chief lords of the fee, then the statute merchant for 400/. and the deed for the rent of 102. shall lose their and John grants that if he is impleaded for the said tenements or any part thereof, that immediately after the plea Edmund or his heirs shall be warned by him thereof at his manor of Wydekeshoo, co. Suffolk, or at his of Hokkele, co. Essex, by view of the neighbours, so that he may be able to go to the place where the plea is pending to warrant the said and if John does not do so and the tenements or any part thereof lost by his default, then the said statute merchant and deed shall be but if John loses the tenements by default of Edmund's warrant after has been warned as aforesaid, by a tried action, and Edmund does not him for the value of what is so lost, then the statute merchant and shall remain in force.
