Memorandum of acknowledgment in the chancery at Otteford Kent, 1 March. Indenture made between Thomas son of William le Skynner of and Thomas de Byriton of Shrewsbury the elder, a gift by the said Thomas son of William made with warranty 41 KDWARD III. 367 Thomas de Byriton, his heirs and assigns, of all his lands, rents services in Churchehanewode and Wodehous under the conditions namely to render yearly to the grantor, his heirs and 40s. at the Annunciation and Michaelmas by even portions that it shall be lawful to distrain for arrears, and if the said rent in arrear one month after any term, and the grantor, his heirs and be not so contented, it shall be lawful for them to enter and again the premises until contented of the arrears and of their Witnesses: William de Eyton, Richard Hord of Neweton, Tristrem, John de Wodehalle, Hugh le Warde, Hugh Hager. Shrewsbury, Sunday after the Purification 41 Edward ITI. of acknowledgment by the parties at Westminster, February. made between Thomas son of William le Skynner of and Thomas de Byriton of Shrewsbury the elder, being defeasance of two statutes merchant made in the town of wherein either is to the other bound in 200/., the one Thomas de Byriton, his heirs or assigns, be impleaded of the rents and services which he has of the feoffment of the said son of William in Churchehanewode and Wodehous in the fee or any parcel thereof by any man with title earlier than presents, shall vouch the said Thomas son of William to warranty, shall prosecute that voucher to judgment for recovery from son of William and his heirs of the value thereof, upon that they shall at the terms contained in a charter indented made by the said Thomas son of William to the said Thomas or within two years after pay or cause to be paid to Thomas of William, his heirs or assigns, 40s. yearly rent issuing from said lands so long as their estate therein shall endure, or profrom so much as shall remain in their possession; and the in case the said Thomas de Byriton and his heirs be so impleaded the said lands or any parcel thereof, and shall make and their voucher as aforesaid, and the said Thomas son of or his heirs, having no lands, rents, services nor reversions simple to the value recovered against the said grantees, shall be ready to pay them in money the value thereof within one of a year after it be so lost, upon condition that the grantees make or be ready to make them a release within eleven weeks such judgment before suing execution thereof.
