To John de Moubray and his fellows, justices of assize in Staffordshire. if there be an assize of novel disseisin pending before them Thomas son of Richard de Covene plaintiff and John de Amice his wife and others defendants concerning tenements Wolverenehampton, and if the proceedings therein have been as recited, to proceed to take that assize and do justice the parties, the allegation of the defendants that the premises held of the king, were aliened without licence, and committed the defendants by exchequer commission for a set farm payable the king notwithstanding, provided always that the said justices not proceed to rendering of judgment without advising the king ; the said Thomas has shewn the king that he arraigned the assize before William de Fyncheden and his fellows late justices assize in that county, putting in view a messuage and appurtenances the said town, and that the said late justices by reason of the aforesaid made in pleading by the said John and Amice off taking the same; and now the assize remains to be taken the justices first above named, and the said plaintiff has prayed remedy, fearing that by reason of the same allegation they will take the said assize.
