Memorandum of acknowledgment in chancery at New Sarum, May. William Latymer to Edmund Flory. Recognisance for 3001., to be etc. in Wiltesir. Edmund Flory to William Latymer. Indenture of defeasance the foregoing recognisance, upon condition that Robert son and apparent of the said William shall, within one month after he marry Isabel daughter and heir of Richard le Vernoun, make a . 443 to the said Edmund and Ellen his wife of all actions for in the manors of Hornynggesham and Kyngeston Deverel to date, that during the said Ellen's life the said William, his heirs assigns, shall make no demise to the said Isabel of the premises of the tenements in Rugge; that if the said William etc. be concerning the same by the said Isabel, they shall make plea as the said Edmund and Ellen, or the said Ellen after her death, will deliver to them, so that it cause not him or his by covin to lose their tenure, and so that such plea be delivered writing indented within one month after request made, otherwise shall make what plea they please ; and that the said William etc. pay 38/. 4s. yearly to the said Edmund and Ellen during Ellen's the first term of payment to be at Midsummer next, according to fine to be levied of the premises between the parties, with proviso then a rent of 40/. reserved by indenture of the premises shall void, and that if by action tried the said William etc. shall lose premises or parcel thereof, the rent shall be recouped having to the value of the land so lost ; bonds of the said Edmund 160/., who has the wardship and marriage of the said Isabel by of the bishop of Winchester for 160/. 13s. 4d., to deliver her to the said William or his executors within one week after said William shall discharge him of paying that sum, of said William that she shall be married to his said son one month after delivery of her body, and of the said for delivery between this and Midsummer of all evidences the said Isabel's heritage which are in his keeping, save whereby Ellen is jointly enfeoffed.
