To the treasurer and the barons of the exchequer. Writ of swpersedeas, and order to discharge Thomas son of Godfrey de Roos and Peter Torold of London skynner mainpernors of Finalaus Ussher of Scotland merchant; as at his suit, averring that in Scone he laded a ship of Seland with sixteen lasts and three barrels of herring, two chests with cloth therein and his harness to be taken to Flanders, that on its voyage the ship was driven by a storm to the river Humbre, and that Thomas de Percy then admiral from the Thames northward and other lieges have arrested and detained those goods contrary to the truce between the king and his cousin Robert of Scotland, and for that the said Thomas son of Godfrey and Peter mainperned under a pain of 100/. that he should answer at a march day for the value thereof if adjudged to the king, the king commanded the admiral or his lieutenant in the port of Kyngeston upon Hull to make restitution to the said merchant ; and now he has petitioned the king for discharge of his sureties, shewing that at divers march days he was ready to answer, and no challenge or impeachment was made, and John king of Castille and Leon duke of Lancastre and the prior of the Hospital of St. John of Jerusalem in England the treasurer have witnessed by word of mouth, and Henry Percy earl of Northumberland one of the wardens of the marches by letters patent, that he appeared as aforesaid, and no man laid aught against him, and he has made oath to appear likewise at the next march day.
