To the treasurer and the barons of the exchequer. Order to view record and process in the exchequer, the estreats of chancery mentioned, and other memoranda of the exchequer conthe business, and if assured that the matters rehearsed true, and that there was no other cause wherefore the same should in the king's hand, to restore to Roger de Saperton the office warden of the Flete prison and the issues thereof arising since it taken into the king's hand, as used to be done in like case, dis- Richard de Claipole and his mainpernors of those issues of rendering account thereof, notwithstanding discrepancies names between the process touching the taking of the body of son of John Horde and the late king's letters patent concerning marriage of Juliana le Rous and the wardship of her father's lands ; upon information received that the said Thomas son of John had the said Juliana, being sister and heir of John son of Thomas Rous tenant by knight service as well of the heir of Rogér de Mortuo earl of March, a minor in the king's wardship, as of the bishopric Hereford then void and in the late king's hand, and being herself age and in the said king's wardship, by letters under the seal the late king appointed the then sheriffs of London and lieges to pursue and take him, and to bring him before the barons the exchequer ; and he was taken and brought before them, and that he abducted the said heir and without licence the king took her to wife, was for that trespass committed to the prison until he should make satisfaction ; and on 23 May in the 45th year of his reign the late king by letters patent granted to Robert de Kendale knight and Maud his wife the marriage of the said Juliana by name of Juliana daughter and heir of Thomas Rous, and on 25 July following by other letters patent granted to them and their executors for payment of a certain sum the wardship of all the lands of the said Thomas Rous in the king's hand by his death and by reason of the nonage of Juliana, with the forfeiture of her marriage and all profits thereto belonging ; and on 22 October in the same year the said office with all things thereto belonging was taken into the king's hand for that the said Richard, being attorney and representative of the said Roger, alleged that he might not bring the body of Thomas son of John Horde before the said barons at their command for that he had escaped from custody, and the said Richard was committed to the Flete, and the same day was by a mainprise found in the exchequer made warden substitute of the said prison, answering to the late king for the issues thereof arising, as may appear by the said record and process and by the estreats of chancery of the said 45th year ; and now the said Roger and Richard have petitioned the king for restitution of the said office and to discharge the said Richard of the issues thereof and of his account, shewing that in name of distress and not otherwise the office was taken into the late king's hand by reason of the said escape, and that the said Richard, by whose default the said prisoner escaped, as attorney of the said Robert (sic) contented the said Robert and Maud to whom belonged the forfeiture of the said marriage, as by acquittance of the said Robert and otherwise they are ready to prove ; and with the advice of learned men of the council the said Roger has made fine with the king by 40s. for the escape aforesaid, and has paid the same in the hanaper.
